Dubai eviction notice — common questions

How much notice do I have to give to evict a tenant in Dubai?

It depends on the reason. For non-payment of rent or a contract breach, the landlord serves a 30-day notice to pay or comply (Law No. 33/2008, Article 25(1)). To evict at the end of the lease for personal use, sale, or demolition/renovation, a 12-month notarised notice is required before the eviction date (Article 25(2)).

Does the eviction notice have to be notarised in Dubai?

Yes. Under Article 25 of Law No. 33/2008, the notice must be served on the tenant either through a Notary Public or by registered mail. A verbal or informal notice is not legally valid.

What is the 12-month eviction notice rule in Dubai?

If the landlord wants to evict at the end of the tenancy because they want to sell, use the property personally, or demolish/renovate it, Article 25(2) of Law No. 33/2008 requires at least 12 months’ notarised notice before the date set for eviction.

What is the 90-day notice in Dubai tenancy law?

The 90-day rule (Law No. 26/2007, Article 14) is separate from eviction. If either party wants to change the lease terms (for example the rent) at renewal, they must notify the other party at least 90 days before the lease expires. It is not a ground to evict.

Can I evict a tenant for not paying rent?

Yes. Under Article 25(1)(a) of Law No. 33/2008, if the tenant fails to pay rent within 30 days of a formal notarised payment notice, the landlord may file for eviction before the Rental Dispute Centre.
